1. PURPOSE

These Terms & Conditions, together with the Cookie and Privacy Policy, govern the use of this website and the purchase of products, and are available at all times on the website. Users are advised to carefully read the Terms & Conditions and Privacy and Cookie Policy before using the website. To place an order, you must be at least 18 years old, or have parental or legal guardian consent if you are a minor. By using this website, you confirm that you meet these requirements.

LUZALBA® may update these Terms & Conditions at any time. Any changes will be published on the website. Continued use of the website or placing an order after updates constitutes acceptance of the revised Terms & Conditions. By using this website, you agree not to place false or fraudulent orders. LUZALBA® reserves the right to cancel any such orders and, where appropriate, report them to the competent authorities.

2. PRICES, SHIPPING COSTS AND DISCOUNTS

Prices displayed on this website apply at the time of order and include VAT at the applicable rate, excluding shipping costs. Prices are shown in the currency of the selected country and may vary depending on location. Shipping costs are calculated at checkout based on the chosen delivery method and are clearly displayed before payment. LUZALBA® reserves the right to change prices and shipping costs at any time, without affecting completed orders. Promotional codes must be entered at checkout to be valid and cannot be applied retroactively.

3. PAYMENTS

The LUZALBA® website is protected by SSL (Secure Sockets Layer) encryption technology, designed to prevent the interception or misuse of data transmitted through online forms. All payment information, including contact details, shipping information, and payment methods (PayPal, Visa, Mastercard, Discover, or American Express), is securely processed and fully encrypted via SSL.

4. DELIVERY

Products are available for delivery only in the countries listed at checkout. Deliveries to post office boxes are not available. Orders are shipped to the delivery address provided at the time of purchase and only after stock availability and payment confirmation. Shipments are handled by LUZALBA’s logistics partners, including CTT and DHL. More information is available at www.ctt.pt and www.dhl.com.

Shipping costs are clearly displayed at checkout. Estimated delivery times are 1–5 working days for Portugal and Spain, 5–20 working days for Europe, and 7–30 working days for the rest of the world. Orders are processed on working days only.

If delivery cannot be completed within the estimated timeframe, LUZALBA® will inform you and offer the option to proceed with a new delivery date or cancel the order with a full refund within 30 days.

5. EXCHANGES & RETURNS

Under EU consumer regulations, customers have 14 days from delivery to request a return or exchange. Return requests must be made within 14 days of delivery, and items must be returned within 21 days. Cancellations are not accepted.

Return shipping costs are the responsibility of the customer. We recommend using a tracked service, as LUZALBA® cannot be held responsible for lost parcels or offer refunds or exchanges in such cases. Before returning any item, please contact info@luzalba.art with your order details, reason for return, and whether you request a refund or exchange. You will then receive return instructions.

For exchanges, please contact us in advance to confirm availability. Alternatively, placing a new order is recommended to ensure the desired item is secured, followed by a return of the original product within the return period.

Once the returned item is received and inspected, you will be notified of approval. If approved, refunds will be issued to the original payment method within a few days. Shipping costs are non-refundable, and refunds are based on the final amount paid after any discounts.

6. PRODUCT VARIATIONS & ORIGINAL ARTWORKS

Each Fish Print results from a long and detailed process, beginning with the careful preparation of the fish and ending with its presentation as a wall piece. The process involves multiple stages, including fabric preparation, natural ink application, printmaking, ironing, sewing, cutting wood and cords, as well as a photographic documentation stage. Through digitalisation, the fish catalogue is also expanded, allowing the work to reach new audiences and markets. However, all printed editions remain limited, signed, and numbered by the artist.

Both the artworks and products often retain the natural characteristics of the materials used in their creation. Variations in grain, texture, knots, and colour are not considered defects, but rather inherent qualities of the materials and part of the uniqueness of each piece. These natural variations are to be expected and embraced as part of the individual artwork.

7. CUSTOMER COMMUNICATIONS

The applicable law requires that certain information and notices be provided in writing. By using this website, you agree to receive communications from LUZALBA® electronically, which satisfies any legal requirement for written form and does not affect your statutory rights.

If you are dissatisfied with your purchase or with the service provided on the LUZALBA® website, you may, without prejudice to your right to bring the matter before the competent courts, refer the dispute to an alternative dispute resolution entity, or via the European Commission’s Online Dispute Resolution platform.

LUZALBA® is an officially registered trademark by the INPI (National Institute of Industrial Property, Portugal). All the information contained in the website, including images, videos, graphic design, wordings and the artistic creations designs are protect by the international COPYRIGHTS© system also the Portuguese Legislative Decree nº143/2014 of 26th September, which aproves the intellectual property law and norms. All the Rights belong exclusively to LUZALBA® (artistic brand property of Daniela da Silva Ferreira | TAX /NIF: PT230509754 | Rua da Bica 4, 8650-222 Budens, Portugal). Any act of reproduction, distributions, transformations or public communication are protectable by the rules of intellectual and industrial property.
